Introduction & Acceptance of Terms

Welcome to the Zenimal mobile application (the "App"). This App is operated by Zenimal, LLC ("Zenimal," "we," "us," or "our").

This App is designed for parents and guardians to manage Zenimal meditation devices for their children. By creating an account and using this App, you agree to these Terms of Service and Privacy Policy.

Eligibility: You must be at least 13 years of age to create an account. By using this App, you confirm that you are 13 years or older and/or are a parent or legal guardian creating an account to manage your child's Zenimal device.

If you do not agree to these terms, please do not use the App.

Service Description

What the App Does

The Zenimal App allows parents and guardians to:

  • Create and manage profiles for children's Zenimal devices
  • Generate AI-personalized meditation content based on child preferences
  • Record custom audio tracks for their child
  • Upload meditation content to Zenimal devices via wireless connectivity
  • Access premium meditation content libraries
  • Customize device settings (nightlight, haptic features)
  • Track device usage and session history
  • Manage subscription services
Device Independence

The Zenimal device can function independently with pre-loaded content without App connectivity. App connectivity is required for:

  • Uploading new content to device
  • AI-generated personalized meditations
  • Accessing premium content library
  • Device customization features
  • Usage tracking and analytics

Once content is uploaded to a device, it remains accessible on the device even if your subscription lapses.

Account Creation & Responsibilities

Account Registration

To use the App, you must create an account by providing:

  • Valid email address
  • Secure password
  • Acceptance of these Terms and Privacy Policy
Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Ensuring your account information is accurate and current

We recommend enabling multi-factor authentication for enhanced security.

Child Profiles

You may create profiles for children to personalize their Zenimal experience. By creating a child profile, you represent and warrant that you are the parent or legal guardian of that child and have authority to provide information about them.

Subscription Terms

Subscription Service

Zenimal offers a subscription service at $6.99 per month (price subject to change with notice). The subscription provides access to:

  • AI-generated personalized meditation content
  • Premium meditation content library
  • Unlimited content uploads to devices
  • Advanced device customization features
  • Parent recording capabilities with unlimited storage
Billing & Payment
  • Billing Cycle: Subscriptions are billed monthly on a recurring basis
  • Payment Method: You authorize us to charge your chosen payment method (credit card, debit card, or app store account) each billing period
  • Automatic Renewal: Your subscription automatically renews each month unless cancelled at least 24 hours before the renewal date

Price Changes: We will provide at least 30 days' notice of any subscription price increases. Continued use after notice constitutes acceptance of new pricing

Free Trials

If we offer a free trial period:

  • Trial duration will be clearly stated at signup
  • You will not be charged during the trial period
  • Your payment method will be charged automatically when the trial ends unless you cancel before the trial expires
  • You may cancel anytime during the trial without charge
Cancellation

You may cancel your subscription at any time through:

  • App settings under "Subscription Management"
  • Your Apple App Store or Google Play Store account settings
  • Contacting customer support at hello@zenimals.com

Effect of Cancellation:

  • Cancellation takes effect at the end of your current billing period
  • You retain access to subscription features through the end of the paid period
  • Previously downloaded content on your device remains accessible
  • New AI generation and premium content access ends at subscription expiration
  • No refunds or credits for partial months
Refund Policy

All subscription fees are non-refundable except:

  • As required by applicable law
  • If we terminate your account for reasons other than Terms violations
  • If a technical error results in incorrect charging

Refund requests must be submitted within 7 days of the charge.

FSA/HSA Eligibility

Zenimal devices are FSA/HSA approved. Check with your FSA/HSA administrator regarding subscription reimbursement eligibility.

Privacy Policy

Privacy Overview - Website vs. App

Understanding Our Two Different Privacy Practices:

We want to be completely transparent about how we handle information differently across our website and mobile app.

Marketing Website (zenimals.com):

  • Uses cookies and tracking for advertising (Meta Pixel, Google Ads)
  • Enables us to show you relevant ads on Facebook, Instagram, and Google
  • Helps us understand which marketing works

Mobile App (Zenimal Parent App):

Why the difference? Our website is where we market Zenimal products. Like most e-commerce sites, we use advertising tools to reach parents who might benefit from Zenimal. However, once you're using our app to manage your child's meditation device, we believe in a completely clean, ad-free, privacy-first experience.

For parents concerned about privacy: The app your child uses (through their Zenimal device) and the app you use to manage it have NO advertising tracking whatsoever. Website tracking only helps us market to new customers.

Information We Collect

Important Note: The information collection practices differ between our website and mobile app. Website tracking includes marketing and analytics tools; the mobile app does not use advertising trackers.

A. Parent Account Information:

Child Profile Information (Provided by Parent):

User-Generated Content:

  • Custom audio recordings created by parents
  • Notes or comments about child preferences

Information We Do NOT Collect:

  • Biometric data
  • Precise geolocation data
  • Social media connections
  • Children's names or birthdates
  • Photos or videos
  • Any personally identifiable information from children directly

Automatically Collected Information

In Our Mobile App:

The mobile app collects minimal technical information:

  • App usage patterns (pages viewed, features used)
  • Session history (synced from your Zenimal device)
  • Device settings and preferences
  • Technical logs for troubleshooting

Important: The mobile app does NOT include:

  • Advertising pixels or SDKs
  • Remarketing trackers
  • Cross-app tracking
  • Advertising identifiers (IDFA/AAID)
  • Any third-party advertising technology

The app's data collection is limited to what's necessary for functionality, personalization, and technical support.

How We Use Information

We use collected information to:

  • Provide, maintain, and improve the App and services
  • Generate AI-personalized meditation content based on child profiles
  • Process subscription payments and manage accounts
  • Sync content between App and Zenimal devices
  • Provide customer support and respond to inquiries

Different Uses for Website vs. App Data:

Website Information (from zenimals.com visits) is used for:

  • Understanding which products interest you
  • Showing you relevant Zenimal ads on social media and Google
  • Measuring effectiveness of our marketing campaigns
  • Improving our website and shopping experience
  • Remarketing to people who visited but didn't purchase

App Information is used ONLY for:

  • Providing app functionality
  • Personalizing meditation content for your child
  • Syncing with Zenimal devices
  • Processing your subscription

We do not use app information for advertising purposes.

AI Content Generation:
We use AWS-powered AI services to generate personalized meditation scripts. The AI analyzes child profile information (age group, identified needs, preferences, past session feedback) to create age-appropriate, trauma-informed content. Parents can review all AI-generated content before uploading to devices.

Information Sharing

We do NOT sell your personal information in the traditional sense (we don't provide your contact information or email lists to other companies). However, under state privacy laws, certain website tracking activities may be considered "sharing" or "sales."

Website Advertising (zenimals.com Only):

When you visit our website, we share information with advertising platforms:

Meta (Facebook/Instagram):

  • Receives: IP address, browser information, pages viewed, items added to cart, purchases
  • Purpose: Show relevant Zenimal ads on Facebook and Instagram, measure ad effectiveness, remarket to website visitors

The Zenimal mobile app does NOT share information with advertising networks. Information from the app is shared only with:

Service Providers (Required for Functionality):

AWS (Amazon Web Services):

  • Purpose: Cloud infrastructure, data storage, AI-powered meditation generation
  • What's shared: Account data, child profiles, usage data, AI-generated content
  • Protection: AWS is contractually bound to protect data and meets industry security standards

Payment Processors (Stripe, Apple, Google):

  • Purpose: Process subscription payments
  • What's shared: Payment information only (we never see full credit card numbers)
  • Protection: PCI-DSS compliant, data not shared back with us

App Analytics (Minimal):

  • Purpose: Understand app crashes, performance issues, feature usage
  • What's shared: Aggregated, non-identifiable technical data only
  • We do NOT use analytics tools that identify individual users

All service providers are contractually required to:

  • Use data only for specified purposes
  • Maintain appropriate security measures
  • Not use data for their own purposes
  • Delete data when no longer needed

Legal Requirements:
We may disclose information if required by law, court order, or government request, or if we believe disclosure is necessary to:

Business Transfers:

Data Security

Session Logs: Usage session logs are retained for 60 days for app functionality and troubleshooting, then automatically deleted unless you request earlier deletion.

While we use reasonable security measures, no system is completely secure. We cannot guarantee absolute security of transmitted or stored data.

Data Retention

Parent Account Data: Retained as long as your account is active, plus 30 days after account deletion for backup purposes.

Child Profile Data: Retained as long as the profile exists in your account. You may delete child profiles at any time.

Usage Data: Session logs retained for 60 days, then automatically deleted.

Custom Recordings: Retained as long as your account is active unless you delete them earlier.

Payment Records: Retained as required by law for tax and accounting purposes (typically 7 years).

Your Privacy Rights

You have the right to:

Access: Request a copy of the information we hold about you and your child's profiles.

Correction: Update or correct any inaccurate information through the App settings or by contacting us.

Deletion: Request deletion of your account and all associated data. You may also delete individual child profiles at any time.

Export: Request a downloadable copy of your data in a portable format.

Opt-Out: Opt out of marketing communications (though we send very few promotional emails).

California Residents: Under the California Consumer Privacy Act (CCPA), you have additional rights. Contact us for details.

International Users: If you are located outside the United States, your information will be transferred to and processed in the United States where our servers are located.

Right to Delete: You may request deletion of personal information we've collected from you, subject to certain exceptions.

Right to Opt-Out of Sale or Sharing: Under CCPA, sharing information with advertising platforms (like Meta and Google on our website) may be considered a "sale" or "sharing" of personal information. You have the right to opt out of this activity.

  • Use the mobile app fully
  • Receive the same subscription benefits and pricing

Children's Privacy

This App is designed for parent and guardian use, not direct use by children. However, the App collects information ABOUT children (as provided by parents) to personalize Zenimal device content.

COPPA Compliance:
While the App is not directed to children under 13, we recognize that we collect information about children through parental input. We comply with the Children's Online Privacy Protection Act (COPPA) regarding this information:

  • We collect only information reasonably necessary to provide personalized content
  • We obtain parental consent implicitly when parents create child profiles
  • Parents have full control to review, modify, or delete their child's profile data

Content Review

Parents can review all AI-generated content before uploading to devices. We recommend reviewing content to ensure it aligns with your child's specific needs and your family values.

Content Standards

All AI-generated content follows strict guidelines:

  • Age-appropriate language and concepts
  • Trauma-informed approaches
  • No dark imagery, violence, or frightening content
  • Inclusive, non-gendered language
  • Evidence-based mindfulness techniques
  • No religious or political content

Content Accuracy

While our AI is designed to create safe, appropriate content, AI systems can occasionally produce unexpected results. We continuously monitor and improve our systems, but cannot guarantee perfection. Please report any concerning content to hello@zenimals.com.

User-Generated Content

Parent Recordings

You may record custom audio tracks for your child's device. These recordings:

  • Are stored securely in your account
  • Are accessible only to you
  • Are not used for AI training
  • Are not shared with other users
  • Can be deleted at any time
Content Ownership

You retain all ownership rights to your recordings. By uploading recordings to our service, you grant Zenimal a limited license to store, process, and transmit your recordings solely to provide the service to you.

Content Restrictions

You agree NOT to create or upload content that:

  • Contains copyrighted material you don't own
  • Is illegal, harmful, threatening, or abusive
  • Contains hate speech or discriminatory content
  • Is sexually explicit or inappropriate for children
  • Violates any third party's rights
  • Contains malware or harmful code

Intellectual Property

Zenimal's Rights

All content provided by Zenimal (pre-loaded meditations, music, app design, AI-generated scripts, logos, trademarks) is owned by Zenimal, LLC or our licensors and protected by copyright, trademark, and other intellectual property laws.

You may not:

  • Copy, modify, or distribute Zenimal's content
  • Reverse engineer the App or devices
  • Extract or redistribute meditation audio files
  • Use Zenimal trademarks without permission
  • Create derivative works based on our content
License to Use

We grant you a limited, non-exclusive, non-transferable license to use the App and access Zenimal content for personal, non-commercial use in connection with your Zenimal device.

Meditation Content Protection

Zenimal meditation tracks are encrypted and protected by digital rights management. Attempting to extract, copy, or redistribute meditation files violates these Terms and applicable law.

Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms.

Prohibited Activities:

  • Using the App in any way that violates laws or regulations
  • Impersonating any person or entity
  • Sharing your account credentials with others
  • Attempting to gain unauthorized access to our systems
  • Interfering with or disrupting the App's functionality
  • Using automated systems to access the App (bots, scrapers)
  • Transmitting viruses, malware, or harmful code
  • Collecting other users' information
  • Using the App for commercial purposes without authorization
  • Circumventing security features or access controls

Violation of these restrictions may result in immediate account termination without refund.

Disclaimer & Limitations

IMPORTANT: Zenimal is a wellness tool, not a medical device or treatment.

While Zenimal devices are FSA/HSA approved for wellness purposes, our App and devices:

  • Are not intended to diagnose, treat, cure, or prevent any medical condition
  • Are not a substitute for professional medical or mental health care
  • Should not be relied upon for medical advice
  • Do not provide therapy or counseling services

If your child is experiencing severe anxiety, trauma, behavioral issues, or mental health concerns, please consult qualified healthcare professionals.

Meditation and mindfulness are complementary wellness practices. They are not replacements for evidence-based medical or psychological treatment.

Service Availability

We strive to provide reliable service but cannot guarantee:

  • Uninterrupted or error-free operation
  • That the service will meet your specific requirements
  • That all bugs or errors will be corrected
  • Availability at all times (maintenance may be required)

THE APP AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

AI Content Disclaimer

AI-generated content is created by algorithms based on training data and your inputs. While we implement safeguards and content guidelines:

  • AI systems can produce unexpected results
  • We cannot guarantee absolute accuracy or appropriateness
  • Parents should review AI-generated content before use
  • We continuously improve our systems but cannot ensure perfection
Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

Zenimal shall not be liable for:

  • Indirect, incidental, consequential, or special damages
  • Loss of profits, revenue, data, or business opportunities
  • Emotional distress or psychological harm
  • Damages arising from use or inability to use the service
  • Any content, including AI-generated or user-generated content
  • Third-party actions or content
  • Unauthorized access to your account or data

Maximum Liability: Our total liability to you for all claims shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

Some jurisdictions do not allow limitation of certain warranties or damages, so these limitations may not apply to you.

Indemnification

You agree to indemnify and hold harmless Zenimal, LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your violation of these Terms
  • Your violation of any rights of another party
  • Content you upload or create through the App
  • Your misuse of the service
  • Your violation of applicable laws

Term & Termination

Term

These Terms remain in effect while you use the App and maintain an account.

Termination by You

You may terminate your account at any time by:

  • Deleting your account through App settings
  • Contacting customer support at hello@zenimals.com
  • Cancelling your subscription (subscription must be cancelled separately)
Termination by Us

We may suspend or terminate your account immediately if you:

  • Violate these Terms
  • Engage in fraudulent activity
  • Abuse the service or our team
  • Provide false information

We may also terminate the service entirely with 30 days' notice.

Effect of Termination

Upon termination:

  • Your access to the App and subscription features ends
  • Content previously downloaded to devices remains accessible
  • We will delete your account data within 30 days (except as required for legal/accounting purposes)
  • No refunds for unused subscription time (except as legally required)

Changes to Terms & Policy

Updates

We may update these Terms and Privacy Policy from time to time to reflect:

  • Changes in our services or features
  • Changes in applicable laws
  • Improvements to clarity or organization
Notice of Changes

We will notify you of material changes by:

  • Email to your registered email address
  • In-app notification
  • Posting updated Terms with a new "Effective Date"

For significant changes affecting children's data collection or use, we will require affirmative consent.

Acceptance of Changes

Continued use of the App after changes take effect constitutes acceptance of the updated Terms. If you do not agree to changes, you must stop using the App and may terminate your account.

Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law provisions.

Informal Resolution

Before filing a claim, please contact us at legal@zenimals.com to attempt informal resolution. We're committed to resolving disputes fairly and quickly.

Arbitration

PLEASE READ THIS SECTION CAREFULLY - IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration rather than in court, except:

  • Small claims court disputes (under $10,000)
  • Intellectual property disputes
  • Injunctive relief requests

Arbitration terms:

  • Conducted by the American Arbitration Association (AAA)
  • Under AAA Consumer Arbitration Rules
  • In California
  • Arbitrator's decision is final and binding
  • You may opt out of arbitration by emailing legal@zenimals.com within 30 days of account creation
Class Action Waiver

You agree to resolve disputes on an individual basis only. You waive any right to participate in class actions, class arbitrations, or representative actions.

If the class action waiver is found unenforceable, the arbitration agreement does not apply.

Exceptions

The following disputes are NOT subject to arbitration and may be brought in court:

  • Small claims court matters
  • Intellectual property infringement claims
  • Emergency injunctive relief

General Provisions

Entire Agreement

These Terms and Privacy Policy constitute the entire agreement between you and Zenimal regarding the App and supersede any prior agreements.

Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.

Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.

Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control (natural disasters, pandemics, wars, internet outages, etc.).

Survival

Sections that by their nature should survive termination (including warranties, disclaimers, indemnification, dispute resolution) continue after termination.

No Agency

These Terms do not create any agency, partnership, or joint venture between you and Zenimal.

By creating an account and using the Zenimal App, you acknowledge that:

✓ You are 13 years or older and/or a parent/guardian
✓ You agree to be bound by these Terms
✓ You consent to collection and use of information as described
✓ You understand this App is for parent use to manage children's devices
✓ You have authority to provide information about your child(ren)

If you do not agree, please do not use the App.
